The possibility of including the maintenance of the expenses of the wife's treatment and health care

Abstract

Article 1107 of the Civil Code (for the year 1314) limits the validity of the wife's maintenance in the legal resources and does not take care of the other needs of the woman, including the expenses of treating the wife and her health care. However, with the amendment of the article in 1381, the cases of woman's alimony, was said and included the said expenses as well. It is understood from the word "usual", which includes all cases of woman's alimony, but is it intended that the word "usual" is for expenses or diseases? In which there is a difference that has significant implications for the husband's costs towards his wife. This study, based on the descriptive-analytical approach and based on the written sources and after the research on the opinions presented, on the one hand, the right view is to include the expenditure on the expenditure and, on the other hand, that the word "usual" is for the expenses not for the diseases. Therefore, in each disease the expenses were regular, the husband paid.
