Criminal liability for abortion caused by paraphilic disorders; jurisprudential and legal analysis

Abstract
Background and Aim: Paraphilic disease is a type of mental disorder, whose symptoms are mainly abnormal sexual acts. According to the latest scientific findings, these patients have committed partial acts of violence at the peak of sexual excitement, and after the intensity of violence increases, their will will return. These violences may end in the abortion of pregnant women.

Materials and Methods: This research, which was conducted by analytical-descriptive method, aims to investigate the criminal liability of abortion by paraphiliac patients.

Conclusion: The final result is that the severity of willpower and discrimination in paraphilic patients is such that they commit minor violence and in severe violence leading to abortion, discrimination cannot be considered completely impaired. Therefore, the criminal responsibility of the paraphilic patient is certain. According to the rule of caution, examples of which are reflected in the Islamic Penal Code, paraphilic patients should not engage in sexual intercourse if they know about the pregnancy of a female, otherwise they commit a deliberate crime, and this is more evident in the words of Sunni jurists. It is necessary that the scientific details of this matter should be mentioned in the regulations of the first note of Article 202 of the Criminal Procedure Code.
