Journal Article 2017 03 15 In some claims, the essential jurisdiction of family court overlaps other authorities including judging and non-judgingones. In some cases, jurisdiction of family court could be associated with other authorities and it seems to be feasible to review the case in both authorities simultaneously (potential and de facto union), in some cases both authorities are qualified to review the care and such interferometry could be combined, however, should the case discussed in one court, it cannot be raised simultaneously in another one (potential combination of jurisdictionand non-aggregation de facto); in some other cases of interferometry, aggregation of jurisdictions seems not to be feasible and the law should determine the competent authority; and the overlapping occurs due to expediency of the cases to be discussed in both authorities and priority of one to the other shall be determined by an authentic authority. The authorities whose essential jurisdiction may overlap family court consist of legal public court, criminal public court, dispute settlement boards and deeds registration departments. Someinterferometry and parallel works could be observed in compromising and settlementbetween the aforesaid qualified authorities. در برخی دعاوی صلاحیت ذاتی دادگاه خانواده در تداخل با مراجع دیگر اعم از قضاوتی و غیرقضاوتی قرار می گیرد. در مواردی، امکان جمع صلاحیت دادگاه خانواده با مرجع دیگر و رسیدگی در هر دو مرجع به صورت هم‌زمان وجود دارد (اجتماع بالقوه و بالفعل)؛ در برخی موارد هر دو مرجع صالح به رسیدگی اند، اما در صورت طرح دعوی در یک مرجع نمی‌توان همان دعوی را هم‌زمان در مرجع دیگر طرح کرد (اجتماع صلاحیت ها به صورت بالقوه و عدم اجتماع به صورت بالفعل)؛ در برخی دیگر از تداخل ها، اجتماع صلاحیت ها امکان‌پذیر نبوده و قانون درباره‌ی مرجع صالح رسیدگی تعیین تکلیف می کند و علت تداخل در این موارد اقتضای رسیدگی در هر دو مرجع و ترجیح یکی بر دیگری با اعتبار معتبر است. مراجعی که صلاحیت ذاتی آنها با دادگاه خانواده امکان تداخل دارد عبارت‌اند از دادگاه عمومی حقوقی، دادگاه عمومی کیفری، شوراهای حل اختلاف، ادارات ثبت اسناد. نتیجه اینکه هر چند قانون‌گذار در تحولات جدید گام های مؤثر برای بهبود وضعیت فعلی برداشته، اما در امر صلاحیت ابهاماتی را ایجاد کرده است. حتی در امر صلح و سازش میان مراجع صلاحیت دار فوق نیز تداخل و موازی کاری هایی می توان مشاهده کرد. https://www.jwss.ir/article_44414_aa5dfa238719e3c67d4386b0eb1063c8.pdf
