Considering to this right is more wide spreading by introducing new reproductive technology and new means of contraception. To understand the view of Islam about this issue we consider quality of legislation in the issue of this right and the way of legislator’s demonstration. Our method in this paper is the last way and by reviewing Quran to prove that reproduction is one of rights of couples in Islam. In this paper, we use the documentary and descriptive- analytical method .In conclusion, by the only one of Quran’s verse is proved the reproductive right in Islam not God’s judgments. In Our view it is better to say the human reproduction in one aspect is a right, also it can be God’s judgments in some condition. In replying we can say in performance of rights we must consider the divine orders. In addition, In Family system, discoursing only about rights is not useful, so the divine legislator in this area prefer obligations then rights to guide the small cell in society. حق تولید مثل و باروری انسان از جمله حقوقی است که توجه سیاست گذاران را به خود معطوف داشته است. توجه به این حق با توسعه ی تکنولوژی های کمک باروری و همچنین روش های جلوگیری از بارداری روزبه روز رو به افزایش است. برای درک نگاه اسلام درباره ی این حق می توان به روش هایی چون چگونگی تشریع حق یا نحوه ی بیان شارع تمسک جست که در این مجال تنها از طریق دوم و بررسی لسان ادله ی (قرآن) حق بودن تولیدمثل ثابت می شود. این پژوهش به روش اسنادی و با استفاده از روش توصیفی- تحلیلی انجام شده است. بر اساس آیه ی 223 سوره ی بقره تولیدمثل در اسلام در زمره ی حق هاست نه احکام، اما تولیدمثل و باروری انسان ضمن آنکه حق است، رنگ حکم نیز به خود گرفته است. بدیهی است که در استیفای حق هم رعایت ضوابط شرعی لازم است. علاوه بر این، در نظام خانواده سخن گفتن صرف از حقوق نمی تواند راه گشا باشد، بلکه شارع مقدس گاه در حوزه ی خانواده جنبه ی احکام را بر حقوق ترجیح داده تا این نظام کوچک را اداره کند. https://www.jwss.ir/article_13237_3f258712c3ba708ba78a60afde94352a.pdf
