This right to privacy is also addressed in matrimonial relationships and the family as the most basic important social foundation. With regard to the importance of the issue, this paper aims to answer the following fundamental questions: what is the position of this right in couples’ relationships, considering family specifications? Which instances can be considered in couples’ relationships? What is the solution if some of these instances interfere with conjugal rights, and which one is preferred? Through scrutinizing the concept of privacy, researching into its documentaries, analyzing the instances in couples’ relationships, and studying its interfering cases in some conjugal rights, it is indicated that privacy is a principle in marital life; however, this right is limited or violated in some cases regarding special family requirements when it interferes with conjugal rights. If it interferes, the limitation or violation occurs so that the most important or prior right is identified and measured against the family consolidation criteria regarding the domain and reasons for each right. Therefore, the very family consolidation interest indicates which right, the right to privacy or other conjugal rights, will be the prior one as the most preferred or the most important right in special cases. امروزه حریم خصوصی به عنوان یک اصل بنیادین و اخلاقی، اهمیت و جایگاه ویژه ای دارد؛ تا حدی که می توان آن را در زمره ی کانونی ترین موضوعات حقوق بشری قرار دارد. این حق در گستره ی خانواده با عنوان مهم ترین و اساسی ترین بنیان اجتماعی و در روابط زوجین نیز مطرح است. نظر به اهمیت موضوع، این مقاله مترصد پاسخ گویی به این پرسش های اساسی است که با توجه به اختصاصات خانواده جایگاه این حق در روابط زوجین چیست؟ چه مصادیقی از آن را می توان در روابط همسران در نظر گرفت؟ در صورت تزاحم این مصادیق با برخی از حقوق زوجیت راه حل چیست و کدام یک رجحان دارند؟ این پژوهش با تدقیق در مفهوم حریم خصوصی، تحقیق در مستندات آن، واکاوی مصادیق این حریم در روابط زوجین و مداقه در موارد تزاحم آن با برخی حقوق زوجیت مشخص می کند در زندگی زناشویی اصل بر داشتن حریم خصوصی است، اما در مواردی با توجه به مقتضیات خاص خانواده در موارد تزاحم با حقوق زوجیت این حق محدود یا نقض می شود. بدین نحو که در فرض تزاحم حق اهم با معیار تحکیم خانواده سنجیده خواهد شد و این مصلحت تحکیم خانواده است که تعیین می کند در موارد خاص کدام یک از حقوق حریم خصوصی یا دیگر حقوق زوجیت به عنوان مرجح و اهم مقدم خواهد شد. https://www.jwss.ir/article_13232_695553c0c5ba292284a3e1e64da6ed47.pdf
