All the juristic propositions related to women in the Islam’s juridical system, or the feministic theorizations are an aspect of different bases of epistemology, anthropology, ontology and axiology. Judging about being superior or inferior, being tyrannically or justly of these propositions is based on evaluation and judging about these bases. Recognizing the human’s reality, the humanity components, the existential dimensions of mankind, begin and end, perfection and affliction, barriers and talents, friend and enemy and …are from the most important anthological subjects as the bases of these value topics. In addition to this recognition method, evaluating and criticizing these ontological and axiological bases would place a broad domain of epistemological and leader-recognizing subjects in our way, through which passing is necessary for achieving and rational defending the reality</strong> تنها زمانی می توان وضعیت حقوقی زنان «نظام حقوق زن در اسلام» و نظریه های «حقوق فمینیستی» را به داوری گذاشت که ملاک صحیحی برای ارزیابی وجود داشته باشد. تک تک گزاره های حقوقی مربوط به زنان در نظام حقوقی اسلام یا نظریه پردازی های فمینیستی، نمودی از مبانی معرفت شناختی، انسان شناختی، مبدأ و هدف شناختی و ارزش شناختی است. قضاوت در مورد فراتری و فروتری، ظالمانه یا عادلانه بودن این گزاره ها مبتنی بر ارزیابی و قضاوت در مورد این مبانی است. شناخت حقیقت انسان، مؤلفه های انسانیت، ابعاد وجودی بشر، آغاز و انجام، کمال و شقاوت، موانع و استعدادها، دوست و دشمن و... از مهم ترین مباحث هستی شناسانه به عنوان مبانی این مباحث ارزشی است. افزون بر این روش شناخت، ارزیابی و نقد این مبانی هستی شناسانه و ارزش شناختی، حوزه ی وسیعی از مباحث راه و راهنماشناسی و معرفت شناختی را فرا روی ما قرار می دهد که گذر از آن برای دست یابی و دفاع عقلانی از حقیقت ضرورت دارد. https://www.jwss.ir/article_12200_b62973ddb1a4d7a0ea30a1052012af19.pdf
