Because of numerous objections posed by feminists against Islamic Law as well as laws of the Islamic Republic in the field of women’s rights, special importance should be attached to this subject. Studying this Code and comparing it with the previous ones, one may say that the present Code has elevated women’s place and tried to create a position for female offenders similar to, or in some case better than, that of male offenders. Taking a differential penal policy concerning victimized women, this Code has considered special penal and non-penal supports for them. In the Chapter of Retaliation and Blood-Money, some developments have been mentioned.  In the Blood-Money Section, it has been mentioned that the difference of woman’s blood-money should be paid from Physical Damage Fund and, in the Retaliation Section, it has been said that the male criminal may be forced to pay blood-money for the female slain and the woman’s blood-money difference may be paid from Public treasury to help heirs of the female slain retaliate the male murderer. بررسی جایگاه زنان در قانون مجازات اسلامی مصوب 1392 یکی از مهم­ترین مباحث مطرح در حوزه­ی حقوق زنان است. اشکال­های متعددی که از سوی فمینیست­ها در مورد حقوق زنان به حقوق اسلامی و قوانین جمهوری اسلامی مطرح می­شود، پرداختن به این موضوع را از اهمیت ویژه­ای بهره­مند می­کند. با بررسی مواد مختلف این قانون و مقایسه­ی آن با قوانین قبلی می‌توان گفت، قانون مجازات اسلامی مصوب 1392 جایگاه زنان را ارتقا بخشیده و سعی داشته برای زنان بزهکار وضعیتی همسان با مردان بزهکار و یا در مواردی خفیف‌تر از آنها را ایجاد کند. این قانون با اتخاذ سیاست جنایی افتراقی در مورد زنان بزه­دیده حمایت‌های کیفری و غیرکیفری خاصی را پیش­بینی کرده است و در قسمت قصاص و دیه نیز به تحولاتی اشاره کرده است؛ در قسمت دیه، پیش‌بینی جبران تفاوت دیه‌ی زن از صندوق تأمین خسارت‌های بدنی و در قسمت قصاص امکان الزام مرد جانی به پرداخت دیه‌ی زن و نیز امکان پرداخت فاضل دیه‌ی زن از سوی بیت‌المال و درنتیجه کمک به اولیای دم زن مقتول، برای قصاص‌کردن مرد قاتل، ازجمله‌ی این راهکارهاست.  https://www.jwss.ir/article_105756_c16bfa745bf6d305adc2cf171f486c49.pdf
