بررسی ماهیت فلسفی و حقوقی نهاد خانواده در منشور بین المللی حقوق بشر

چکیده

اعلامیه جهانی حقوق بشر و دو میثاق بین‌المللی برخاسته از آن، به منظور حفاظت از حقوق اساسی انسان و جلوگیری از درد و رنج مضاعف او به ویژه پس از تجربه دهشتناک دو جنگ جهانی به تصویب رسید. با وجود این، تصریح این سه سند به اهمیت خانواده و ضرورت حمایت از آن و اختلاف رویکرد نهادهای بین‌المللی و منطقه‌ای حقوق بشر در این حوزه، پرسش-هایی را مطرح ساخته است. پرسش اول آن است که رویکرد فلسفی و حقوقی نسبت به نهاد خانواده در ظرف منشور بین-المللی حقوق بشر چیست؟ حقوق‌دانان بین‌المللی معاصر بر این باورند که منظومه حقوق بشر، سه نسل از حقوق را تجربه کرده است؛ دو نسل اول ناظر به حقوق فردی و نسل سوم مشتمل بر حقوق جمعی و گروهی. با این توضیحات حمایت از نهاد خانواده در کدام چارچوب، بسترسازی شده است؟ این پژوهش برای پاسخ به پرسش های مذکور با استفاده از روش توصیفی-تفسیری و اسنادی به بررسی گفتمان فلسفی و حقوقی در اعلامیه و میثاقین پرداخته است. رویکرد تفسیری بکارگرفته شده در این مقاله مطابق با قواعد عام تفسیری حقوق معاهدات «مولف‌محوری» و «متن‌محوری» است. یافته‌ها نشان می‌دهد حقوق بشر در معنای عام خود در چارچوب مکتب حقوق طبیعی معنا دارد و خانواده نیز در سازوکار حقوق طبیعی و با خاستگاه طبیعی مورد توجه قرار گرفته است؛ همچنین شخصیت حقوقی نهاد خانواده مشتمل بر رویکرد منحصر بفرد فردی-نهادی در میثاقین است.
